I do not want to receive information or offers via email or standard mail. What do I do?

If you do not want to receive postal, email or telemarketing offers from us, please let us know by updating your profile or send us an email message, call, or write to us, telling us that you do not want to receive offers from our company.

Will my personal information be sold, exchanged, or released to a third party?

No, Mitchell's Salon & Day Spa Inc. does not sell, exchange, or release your personal information, such as your name, email address, or telephone number to a third party.

PARTICIPATION IN THE PROGRAM

Enrollment, membership and all related benefits of the Program are offered at our discretion. By enrolling or using the Program or collecting Beautiful Rewards points, you agree that you have read and understand these Terms and Conditions and are bound by all of them, as changed from time to time, and you consent to our collection and use of your personal information in accordance with our Privacy Policy.

Members can only enroll in the Program for themselves, and may not collect Beautiful Rewards points or redeem Beautiful Rewards points for anyone other than themselves. Members cannot represent or act as proxy for other members or non-members.

Mitchell's Salon & Day Spa Inc. reserves the right at any time to limit Program enrollment. We may discontinue membership privileges and void or cancel a member's entire point balance if any points in the member's account are issued, received or redeemed through fraud or theft or otherwise illegally or not as authorized in these Terms and Conditions or in other current Program rules. These rights are in addition to any other legal or equitable remedy which may be available to Mitchell's Salon & Day Spa Inc. under applicable law.

MEMBER OBLIGATIONS

Members shall comply with all rules, laws, and regulations that are applicable. Members acknowledge that they may only participate in the Program if and to the extent that such participation is permitted by such laws, rules, and regulations. Mitchell's Salon & Day Spa Inc. may refuse at any time to enroll a member, or to restrict, modify, or terminate a member's participation in the Program without liability to the member or any other party, if a member violates any law, rule, or regulation, or if a Member's participation in the Program violates any law, rule, or regulation.

Members agree not to forward any Beautiful Rewards promotions or offers to other Members or non-Members without first obtaining the express written permission of Salon & Day Spa Inc. Mitchell's Salon & Day Spa Inc. offers are specifically targeted to individual Members unless otherwise stated.

Members agree to provide only accurate and true information to Mitchell's Salon & Day Spa Inc. at all times.

Members agree to comply with all terms and conditions herein and in of, partner offers, and promotions at all times.

Members agree to promptly notify Mitchell's Salon & Day Spa Inc. of any change in address (mail or email) by updating personal information at www.MitchellsSalon.com. This includes notifying Mitchell's Salon & Day Spa Inc. if your Card is lost or stolen.

COLLECTION OF BEAUTIFUL REWARDS POINTS

You must identify yourself as a Member and present your Card in order to earn Beautiful Rewards points on qualifying purchases. Beautiful Rewards points will be only be issued on the retail price of your purchases, minus discounts, shipping and handling. We may refuse to record or honor Beautiful Rewards points in your account, or if already recorded, we may cancel them, if we cannot confirm that they were properly issued or obtained.

Except where required by law or provided for in the program rules, Beautiful Rewards points have no cash value.

REDEMPTION OF BEAUTIFUL REWARDS POINTS

Beautiful Rewards points may be spent only on awards offered through www.mitchellssalon.com. At the time of redemption, Members will be asked to identify themselves by presenting their membership card for in-store redemption, and their username and password for redemption online at www.MitchellsSalon.com. Only the Member or authorized household cardholder (as defined below) may redeem Beautiful Rewards points.

Beautiful Rewards points will be subtracted from a member's account once the award is requested.

Mitchell's Salon & Day Spa Inc. reserves the right to refuse a refund or exchange of Beautiful Rewards points to a Member if merchandise is returned, lost, stolen or destroyed.

We assume no responsibility for any loss, damage, defect, injury, death or expense relating to any award.

TRANSFERABILITY OF BEAUTIFUL REWARDS POINTS

Beautiful Rewards points may never be sold, exchanged, bartered, transferred or given. The Card is the property of Mitchell's Salon & Day Spa Inc., to whom it must be returned upon request. It is non-transferable.

Beautiful Rewards points are not sold to Merchants, or any other persons, the title thereto being expressly reserved at all times in the Mitchell's Salon & Day Spa Inc.. The only right a Member acquires in Beautiful Rewards points is to surrender them for redemption. In case of any other transfer, Mitchell's Salon & Day Spa Inc. reserves the right to invalidate them and/or to reject or restrain their use by, and/or to take them from, the transferee.

LIMITATION OF LIABILITY

We do not have any responsibility or liability for any expense, loss, cost, injury, damage, delay, travel cancellation, accident or any other matter or thing whatsoever (collectively, "Costs"), however suffered or caused (including compensatory, incidental, indirect, special, punitive, consequential or exemplary damages or damages for loss of income or profits), directly or indirectly arising out of or related to (i) the Program or your participation in the Program; (ii) any failure, delay or decision by us in administering the Program or amending these Terms and Conditions or the basis on which you can redeem Beautiful Rewards points; (iii) unauthorized use of your Card; (iv) any offer, representation, statement or claim about the Program, any Partner or Supplier or their products or services, made by a Partner, Supplier or any other person; or (v) the purchase, redemption for or use of any goods or services of Partners or Suppliers, including any Awards, whether made available by us, any of our affiliates, Partners, Suppliers or otherwise. This applies even if we or our representatives are advised of the possibility of such Costs. Partners are not responsible for the Program.

NO WARRANTY

MITCHELL'S SALON & DAY SPA INC. PROVIDES ITS WEB SITE AND SERVICES "AS-IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. AND ITS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights and you may also have other legal rights that vary from state to state.

TERMINATION, CHANGES AND BREACH

Mitchell's Salon & Day Spa Inc. reserves the right, at its sole discretion, to suspend or terminate the Beautiful Rewards program, to add, delete or change Beautiful Rewards points, to modify or limit the use of redemption of any awards in any respect, to modify or change redemption procedures, including the number of Beautiful Rewards points required for particular awards, to modify or limit the collection of Beautiful Rewards points, including but not limited to imposing time limits and changes in point values, and to alter, limit, modify or add to the Beautiful Rewards points program rules, regulations, terms and conditions. We may make these changes to any aspect of the Program, all without notice and even though changes may affect the value of Beautiful Rewards points already accumulated without prior notice at any time and from time to time.

GENERAL

These Terms and Conditions may be different from what you know about the Program. These Terms and Conditions constitute the entire agreement between you and us regarding your participation in the Program, your entitlement to collect and redeem Beautiful Rewards points and your entitlement to any other benefits of the Program, and supersede all previous versions. Except as expressly contained in these Terms and Conditions, there are no conditions, representations, warranties, express or implied, statutory or otherwise. When you deal with us over the Internet, you consent to the formation of contractual relations through electronic communications. We are the final authority as to the interpretation of these Terms and Conditions and as to any other questions or disputes regarding the Program or any Award.
